To the extent permitted by mandatory law, any dispute, controversy, or claim arising out of or relating to these Terms, the service, or their validity, breach, termination, or enforceability shall be finally resolved by arbitration seated in Zug, Switzerland, in English, before one arbitrator.
To the extent permitted by mandatory law, the sole arbitrator shall be selected by Sequester AG. If that selection mechanism is not enforceable or a competent authority requires a neutral appointment process, the sole arbitrator shall instead be appointed under the Swiss Rules of International Arbitration of the Swiss Arbitration Centre, or by the competent court or appointing authority in Zug.
To the extent permitted by mandatory law, disputes must be brought only in an individual capacity and not as a plaintiff, class member, representative, or private attorney general in any class, collective, consolidated, or representative proceeding. If this waiver is not enforceable for a claim, that claim may proceed only to the minimum extent required by mandatory law.
Either party may seek interim, injunctive, or conservatory relief from a competent court where necessary to protect intellectual property, confidential information, data security, or the availability of the service.
